District Court In Panhandle Hears 14 Pleas

Panhandle – On Monday, Nov. 24, 2014, 14 pleas took place in Carson County, Texas.
Luke Inman, the District Attorney for the 100th Judicial District, assisted by Scott Sherwood, prosecuted the cases for the State of Texas with the Honorable Judge Stuart Messer presiding.
1. Cody Don Russell was convicted and sentenced for a period of 18 months for the state jail felony offense of possession of a controlled substance.
Russell, 27-year-old resident of Pampa, was arrested in Carson County for the offense that took place May 9, 2012 by Carson County Deputy J.C. Blackburn, and pleaded to an information filed by the State on November 24, 2014.
Pursuant to the plea agreement, Russell is required to pay $370 in court costs and $180 restitution.
2. Donald Wesley Anders was placed on probation for a period of two years for the Class A misdemeanor offense of possession of marijuana. Anders pleaded guilty and was placed on deferred adjudication for the offense.
Anders, 33-year-old resident of Las Vegas, Nev., was arrested in Carson County for the offense that took place Nov. 7, 2013 by DPS Trooper Ben Dollar. Anders pleaded guilty to an information filed by the State on March 19, 2014.
Pursuant to the plea agreement, Anders was required to pay a fine of $4,000 to Carson County, of which $2,000 was paid upfront, $336 in court costs, $180 restitution, and successfully complete 100 hours of community service. If Anders violates probation, he could face up to one year in the Carson County jail.
3. Jorge Sanchez Martinez was placed on probation for a period of six years for the second degree felony offense of possession of marihuana. Martinez pleaded guilty and was placed on deferred adjudication for the offense.
Martinez, 23-year-old resident of Pacoima, Calif., was arrested in Carson County for the offense that took place Oct. 18, 2014 by DPS Trooper Casey Dawson, and pleaded to an information filed by the State on Nov. 24, 2014.
Pursuant to the plea agreement, Martinez is required to pay a $6,000 fine to Carson County, $336 in court costs, $180 restitution, and successfully complete 300 hours of community service. If Martinez violates probation, he could face up to 20 years in the Institutional Division of the TDCJ.
4. Martinez was also placed on probation for a period of six years for the third degree felony offense of possession of a controlled substance. Martinez pleaded guilty and was placed on deferred adjudication for the offense.
Pursuant to the plea agreement, Martinez is required to pay $336 in court costs and $180 restitution. If Martinez violates probation, he could face up to 10 years in the Institutional Division of the TDCJ.
5. Jared Villasenor was placed on probation for a period of two years for the second degree felony offense of money laundering. Villasenor pleaded guilty and was placed on deferred adjudication for the offense.
Villasenor, 34-year-old resident of Henderson, Nev., was arrested in Carson County for the offense that took place Aug. 9, 2012 by Dawson, and was later indicted by a Carson County Grand Jury on Sept. 30, 2014.
Pursuant to the plea agreement, Villasenor is required to pay a $500 fine to Carson County, $296 in court costs, and successfully complete 300 hours of community service. If Villasenor violates probation, he could face up to 20 years in the Institutional Division of the TDCJ.
6. Gilberto Garcia was convicted and sentenced for a period of ten years to the Institutional Division of TDCJ, but the sentence was probated for a period of three years for the third degree felony offense of evading arrest. Garcia pleaded guilty to an information filed by the State on Nov. 21, 2014.
Garcia, 33-year-old resident of Memphis, was arrested in Hall County for the offense that took place Oct. 3, 2014 by Memphis Police Chief Chris Jolly.
Pursuant to the plea agreement, Garcia is required to pay a $2,500 fine to Hall County, $381 in court costs, and successfully complete 200 hours of community service. If Garcia violates probation, he could face up to 10 years in the Institutional Division of the TDCJ.
7. Garcia was also convicted and sentenced for a period of two years to the State Jail Division of TDCJ, but the sentence was probated for a period of three years for the state jail felony offense of driving while intoxicated with a child passenger. Garcia pleaded guilty to an information filed by the State on Nov. 21, 2014.
This arrest took place on the same date as the evading arrest in a motor vehicle.
Pursuant to the plea agreement, Garcia is required to pay $381 in court costs and $180 restitution. If Garcia violates probation, he could face up to two years in the State Jail Division of the TDCJ.
8. Bounmy Somchay was placed on probation for a period of three years for the third degree felony offense of assault family violence. Somchay pleaded guilty and was placed on deferred adjudication for the offense.
Somchay, 41-year-old resident of Groom, was arrested in Carson County for the offense that took place April 6, 2014 by Carson County Deputy Terry Atchley. Somchay was indicted by a Carson County Grand Jury on Sept. 30, 2014.
Pursuant to the plea agreement, Somchay is required to pay a $3,000 fine to Carson County, $271 in court costs, and successfully complete 200 hours of community service. If Somchay violates probation, he could face up to 10 years in the Institutional Division of the TDCJ.
9. Michael Joseph Sandoval was placed on probation for a period of five years for the second degree felony offense of possession of a controlled substance. Sandoval pleaded guilty and was placed on deferred adjudication for the offense.
Sandoval, 33-year-old resident of Farmington, Mo., was arrested in Carson County for the offense that took place March 14, 2013 by DPS Trooper Danny Nunez, and was later indicted by a Carson County Grand Jury on Aug. 7, 2014.
Pursuant to the plea agreement, Sandoval is required to pay a $5,000 fine to Carson County, $336 in court costs, $180 restitution, and successfully complete 300 hours of community service. If Sandoval violates probation, he could face up to 20 years in the Institutional Division of the TDCJ.
10. Rodger Dale Daniells was convicted for a period of two years in the State Jail Division of TDCJ for the state jail felony offense of burglary of a building on two separate occasion, as well as two convictions for unauthorized use of a motor vehicle.
Daniells, 37-year-old resident of Borger, was arrested in Carson County for the offenses that took place May 16, 2014 by Panhandle Police Chief Sace Hardeman. Daniells was later indicted by a Carson County Grand Jury on Sept. 30, 2014 on multiple counts.
Pursuant to the plea agreement, Daniells received four convictions and is required to pay $315 in court costs in each case.
11. David Alan Alfred was placed on probation for a period of three years for the state jail felony offense of possession of a controlled substance. Alfred pleaded guilty and was placed on deferred adjudication for the offense.
Alfred, 32-year-old resident of Amarillo, was arrested in Carson County for the offense that took place Oct. 7, 2014 by Blackburn. Alfred pleaded guilty to an information filed by the State on Nov. 24, 2014.
Pursuant to the plea agreement, Alfred is required to pay a $2,500 fine to Carson County, $336 in court costs, $180 restitution, and successfully complete 100 hours of community service. If Alfred violates probation, he could face up to two years in the State Jail Division of the TDCJ.
